• You are not accessing the Service from the European Union or other restricted regions

Excavation Expert reserves the right, at its sole discretion, to reject, disable, reassign, or reclaim any subdomain — including subdomains that have already been assigned — that we determine to be in violation of this policy, that appear designed to squat on valuable keywords, that infringe on another party's intellectual property, or that we otherwise deem inappropriate. Where practical, we will notify the affected account prior to action, but we may act without prior notice when we believe immediate action is warranted (including in cases of suspected trademark infringement, impersonation, or squatting). You have no proprietary rights in any subdomain assigned to you; the subdomain is licensed for your use under these Terms and remains under our control.

By using our services, you grant Excavation Expert and its operating company, Montana AI Solutions, LLC, a non-exclusive, royalty-free, worldwide license to display and use your name, logo, and trademarks for marketing and promotional purposes. This includes, but is not limited to, use in case studies, presentations, proposals, advertising materials, and on our website and social media channels.

You retain all ownership rights in your name, logos, trademarks, and intellectual property. Our use of your marks does not transfer or diminish your rights in any way.

12. Limitation of Liability

TO THE FULLEST EXTENT OF THE LAW (AND UNLESS EXCAVATION EXPERT HAS ENTERED INTO A SEPARATE WRITTEN AGREEMENT THAT OVERRIDES THESE TERMS), EXCAVATION EXPERT WILL NOT BE LIABLE FOR ANY LOSS, INJURY, CLAIM, LIABILITY, OR DAMAGE OF ANY KIND RESULTING FROM YOUR USE OF THE OFFERINGS, ANY FACTS, CONTENT, OR OPINIONS APPEARING ON OR THROUGH AN INTERACTIVE AREA, OR ANY THIRD-PARTY CONTENT OR THIRD-PARTY SERVICE. EXCAVATION EXPERT WILL NOT BE LIABLE FOR ANY SPECIAL, DIRECT, INDIRECT, INCIDENTAL, PUNITIVE, OR CONSEQUENTIAL DAMAGES, LOST PROFITS, LOST REVENUE, LOST BUSINESS OPPORTUNITIES, LOSS OF DATA, OR REPUTATIONAL DAMAGES (E.G., OFFENSIVE OR DEFAMATORY STATEMENTS) OF ANY KIND WHATSOEVER (INCLUDING, WITHOUT LIMITATION, ATTORNEYS' FEES) IN ANY WAY DUE TO, RESULTING FROM, OR ARISING IN CONNECTION WITH THESE TERMS, THE USE OF OR INABILITY TO USE THE OFFERINGS, THE INTERACTIVE AREAS, OR ANY THIRD-PARTY CONTENT OR THIRD PARTY SERVICES.

Excavation Expert does not represent or warrant that the Offerings will be error-free, free of viruses or other harmful components, that defects will be corrected, or that they will always be accessible. Excavation Expert does not warrant or represent that content or information available on or through the Offerings will be correct, accurate, timely, or otherwise reliable.

14. Indemnification

You agree to indemnify and hold us harmless from any claims, damages, or expenses arising from your use of the Service or violation of these Terms.

15. Termination and Data Return

Either party may terminate these Terms at any time. We may suspend or terminate your access for violations of these Terms.

Account Deletion: Business owners may submit account deletion requests at any time via their settings page. Upon receiving a deletion request, your account access will be removed within 24 hours. You are responsible for exporting all your data before disabling your account.

Data Handling Upon Termination:

• Your account access will be removed within 24 hours of submitting a deletion request
• You are responsible for exporting all data before account deletion
• We will securely and permanently delete your data within 30 days of account removal unless required by law to retain it
• Any confidential information will be permanently destroyed and not retained for any purpose after the 30-day period
• We will not use your data for AI training or any other purpose after termination
• Upon request, we will provide confirmation of data deletion

16. Governing Law

These Terms are governed by the laws of Montana, United States of America. Any disputes will be resolved in the courts of Montana. This service is provided by Montana AI Solutions, LLC.

17. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes and your continued use constitutes acceptance of the updated Terms.

18. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.

19. Client Responsibility for Legal Documents

Client acknowledges and agrees that any legal documents, contracts, agreements, forms, policies, or other legal materials ("Client Documents") provided to Excavation Expert ("the Company") are the sole responsibility of the Client. Client represents and warrants that they have the right to use, distribute, or rely upon such Client Documents. Excavation Expert does not review, verify, interpret, edit, or provide legal advice regarding Client Documents.

20. No Legal Advice or Attorney-Client Relationship

Excavation Expert is not a law firm and does not provide legal advice, legal opinions, or legal services. No attorney-client relationship is formed by providing services related to Client Documents. Any use of Client Documents is done at Client's sole risk.

21. Limitation of Liability for Legal Documents

Excavation Expert shall not be held liable for any damages, losses, costs, liabilities, or claims (including, without limitation, direct, indirect, incidental, special, consequential, or punitive damages) arising from:

• Client's use of their own legal documents
• Any errors, omissions, ambiguities, or unenforceability in Client Documents
• The failure of Client Documents to meet legal or regulatory requirements in any jurisdiction

Client agrees to indemnify, defend, and hold harmless Montana AI Solutions, Excavation Expert, its officers, employees, and affiliates from and against any claims, damages, or liabilities arising out of Client's use of Client Documents.

22. Recommendation to Seek Independent Legal Counsel

The Company strongly recommends that the Client consult with a licensed attorney to review, draft, or approve any legal documents prior to use. The Client's reliance on Client Documents without such review is at their own risk.

23. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the United States, Canada, and the laws of any state in which enforcement is sought, without regard to conflict of law principles. Any disputes arising under these Terms may be brought in a state or federal court of competent jurisdiction located within the United States.

24. Entire Agreement

These Terms constitute the entire agreement between the Client and the Company regarding liability for Client-supplied legal documents and supersede any prior agreements, whether written or oral.
